___________________________

A dreadful accident resulting in the killing of a little boy occurred on Friday last in the village of Milford [Otsego Co. NY].  The facts are these:  Orlando Sebolt keeps a blacksmith shop, and his oldest son works with him.  One of them owned a shot gun, which they had that day repaired.  The son loaded it and told his father to fire it off.  He stepped to the door to do so, but seeing a horse standing near said that it might frighten him, and he would defer it.  He took the cap from the gun and stood it in a corner of the shop and the two went to dinner.  Soon after a younger son, aged about fourteen came from school and stopped at the shop in company with a lad of seven years named Horace L. Squires, the grandson of Sebolt.  The latter remaining on the outside of the shop and was in the act of looking though a crack in the building when young Sebolt took the gun, fitted a cap to it which he found in a bench drawer, placed the gun close to the crack and fired, the charge entering the head of his young nephew and killing him instantly. An inquest was held by Coroner Parshall where the above facts were stated.  The boy who did the shooting says that he did not suppose the gun was loaded, did not think that any ammunition was kept in the shop, and he only thought to startle the lad by exploding the cap.  Of the truth of which story there was no question.

When will people learn to keep loaded weapons out of the reach of children?  And let children and others bear in mind that the statute makes the pointing of a gun or pistol at any person a misdemeanor for which they can - and as a rule should be - punished by fine row imprisonment.

News Item

Dr. Dan. Foote of South New Berlin [Chenango Co. NY], who is charged with killing his wife by ill treatment, was arrested in Warren County, Pa. and is now in Chenango County.  Insane of course!

Chenango Telegraph, Norwich, NY, February 24, 1847:  Dr. Secor, Coroner, was called on Thursday last, to hold an inquest on the body of a Mrs. Foote (wife of Dr. Dan Foote) who died the night previous.  A postmortem examination was had, and the verdict of the jury was that she came to her death through violence inflicted upon her person by her husband.  We understand that the inhuman monster has been in the habit of beating his wife, who is represented as having been a harmless, inoffensive woman.  About four weeks ago, he abused her in a shameful manner and immediately absented himself from home.  She was, from these injuries, confined to her bed for several days, but at last in a measure recovered.  About two weeks ago, Foote returned and soon after his wife ran into the street, a maniac, it not being known whether he had indulged in a repetition of his outrages.  Foote left for parts unknown while his wife lingered in great distress and in a deranged state of mind until she died.  Foote's whereabout, since he left South New Berlin, the scene of his murderous cruelty, have been ascertained and we hear that a Telegraph message was dispatched form Utica on Friday to the mayor of Buffalo, to put a police officer on her track.  We trust the villain will be apprehended.

Chenango Telegraph, Norwich, NY, March 3, 1847:  We last week related an instance of brutality and death, in which Dr. Dan Foot of South New Berlin was the actor, according to the verdict of the Coroner's Jury, rendered over the dead body of his wife.  We also stated that his whereabouts had been ascertained and that measures were adopted calculated to secure his arrest.

Foote on leaving New Berlin, after  his wife became insane, undoubtedly in consequence of his abuse and violence, went to Fredonia, Chautauqua, Co. [NY] and, not dreaming we presume, that death would so soon overtake his victim, wrote to her brother who resides in Michigan that for certain reasons which he assigned, he should not live with her longer, and (as we are informed) requested him to provide for her for the future. The brother on reading this letter, immediately enclosed it to Elder chamberlain at South New Berlin, making inquiries as to the facts of the case. Learning his temporary residence, Mr. John Sergeant left this county, in company with Constable Mott Burr of Sherburne, for Fredonia.  On arriving at that place, the "bird had flown," he having left for Pennsylvania. They tracked him to Warren Co. Pa. where a warrant was issued on which he was arrested and rather than to be imprisoned there until a requisition could be obtained from Governer Young, he voluntarily consented to return with them.  On Thursday or Friday last, they reached South New Berlin, but the examination was postponed until today (Thursday) in consequence of the indisposition of the prisoner.  He has employed able counsel in this defense, but if we are correctly informed as to the character of the evidence, a commitment will inevitably follow.  We should not prejudge the miserable man, who if guilty of the crime imputed to him, will be legally arraigned at the bar of Justice.
