The trial of Robert Corbin, indicted for the murder of Elliot J. Kidder, at Afton [Chenango Co., NY], February 10, 1868, was moved by District Attorney, R.A. Stanton, Esq., on Wednesday last, before the Supreme Court now in session, Judge Balcom presiding, justices Briggs and Kelsey on the bench.

Counsel for People:  District Attorney R. A. Stanton, the former District Attorney C.L. Tefft, Hon. Lyman Tremain and Rexford & Kingsley.

Counsel for Defense:  Sayre & Winsor, I.S. Newton, Esq., E.H. Prindle, Esq., and Hon. Amasa J. Parker.

The following were the Jurors empaneled in the case, a considerable number drawn being disqualified either from having formed an opinion, or from conscientious scruples, a few only being peremptorily challenged by counsel:

The case was ably opened by the District Attorney, who detailed the circumstances attending the homicide, and the evidence upon which the people would rely, for the conviction of the prisoner at the bar.

Some ten or a dozen witnesses were sworn on the part of the prosecution, three or four of whom witnessed the affray and related in full the circumstances attending the killing of Kidder by Corbin.

That the reader may better understand the facts in the case, and the evidence, which as much as possible we are obliged to condense, it may be worthwhile to remark, that in the town of Afton, some five or six miles from Bainbridge, there is and long has been a piece of land in dispute, between Kidder, Corbin, the Caswells and perhaps others, known as the "Log House lot," adjoining or near another known as the "White House Lot," on which Kidder had, or was in possession of at the time.  On the day of the affray, the 10th of February 1868, Kidder with several persons in his employ, among them F. Delong, H.J. Lake and boy, Ebenezer and Riley Colton, H.R. Wheeler and Lewis DeLong were at work on the premises.  Between 4 and 5 o'clock of that day, two teams with a double and single sleigh, containing some nine or ten persons, drove upon the hill, ostensibly, if any purpose was avowed, to bring away a pair of oxen belonging to Robert Corbin, sent on the lot for a load of wood, and which Kidder, it is stated had restrained.  In this party was Robert Corbin and his son, Charles, H. and V. Caswell, one Lattemore, Chas. Wood, Geo. Teed, George Fox and William Mallory.  When driving up the hill and within a certain distance of the lot, Kidder, who had been notified of their approach as appears from the evidence, came down the hill, with ax in hand hallooing "whoa! stop!" forbidding them proceeding any father as the premises were his.  The team was stopped whereupon Corbin jumped out of the sleigh, receding before the advance of Kidder, till he went down in the snow.  At this point some discrepancy will be noticed in the evidence in regard to the use of the pistol, some of the witnesses testifying that one was presented and snapped by Corbin, others that they neither saw nor heard anything of the kind.  Disagreement to some extent will also be noticed on other particulars.

The first witness for the people was Francis Delong, who testified in substance as follows:  Knew Kidder; was loading logs in the employ of Kidder when Corbin and his men come up; Kidder told them they must not drive any further on his premises; he halted the team; Corbin fell down; Mallory clinched Kidder; Corbin came around and shot Kidder; saw pistol; was standing six feet in front of horses; was one rod from the parties at the time of shooting; Mallory backed Kidder 16 or 18 feet out of the road on the right hand side, having hold of Kidder and the ax at the same time; don't know whether Kidder had hold of Mallory or not; Corbin was near the sleigh; he had to go about two rods to get to Kidder; he was 4 or 5 feet from him when he shot him; Kidder stood sideways towards Corbin, when he fired; told Corbin as he passed, on answer to his inquiry, that I was drawing logs for Kidder, not fighting for him; the team belonged to Geo. Fox; after Corbin fell, heard Lattemore say, "kill him, d...m him!"  Kidder was between witness and sleigh at this time, with Mallory; Kidder told Corbin he owned the premises, and he must not drive on them; saw Kidder fall; after report of pistol he fell on his right side and died instantly; I raised his head and put his hat under it, and said, "he is dead;" at the time Corbin passed me saw pistol for the first time; don't know whether it was cocked or not; don't know which hand he fired from; think it was his right; when Corbin fell Kidder was pretty close to him; Kidder was holding the ax; he did not attempt to strike Corbin; did not see any kicking by Mallory; could not tell whether Kidder struck at Corbin or not; think Mallory met Kidder in the road; did not see any blows struck; Mallory was four or five feet in front of the horses when he clinched Kidder; after Kidder fell, they all left and passed by towards the log house.

The cross examination elicited no material facts in the case.

Killed - Michael Harrington

About noon on Friday last, Michael Harrington, an employee on the Waupaunaukau quarry, in North Norwich [Chenango Co., NY], excavating stone for the midland, was instantly killed by the falling or sliding of a quantity of earth, nearly burying the whole body.  His skull was terribly fractured, the bones driven in upon the substance of the brain; the entire head and face, in fact, being flattened and mangled.  One arm was also fractured in two or three places, and his person otherwise injured.

The deceased, as far as it is known, is without a friend or relation in the world.  He has followed the sea for a number of years, till shortly before he commenced work on the midland, and during the Rebellion was engaged on board a man of war.  He is spoken of by Mr. Tenbroeck and others as an industrious young man, with good habits, worthy of a better situation, which it was the intention of his employers to give him, when an opportunity offered.  His age was about 23 years.  

Coroner Avery held an inquest, the verdict of the jury being substantially as we have stated. The deceased was respectably buried by our Irish citizens, on Saturday.

In this village [Norwich, Chenango Co., NY], Jan. 29th, Mr. Elijah Lewis, in the 75th year of his age.  He was for more than fifty years a much-respected resident of this place.

Mr. Lewis was one of our eldest inhabitants, having removed into our village nearly or quite fifty-three years ago, from the State of Massachusetts in which he was born.  And during all that long time he has been universally respected and esteemed as one of our most reliable and upright citizens.  Some thirty-eight years ago, he experienced religion and united with the Baptist church in this village of which he was an active and consistent member till he died, and, in his last hours, he gave full evidence that his trust, and that hope which had so long sustained him were not in vain, for he died as he had lived, in the full triumph of the Christian faith.  His life was an active one.  No one got any encouragement for idleness from his example.  He was always diligent in his business and excelled in his profession - that of a housebuilder, and his workmanship is found in every part of our village, and it was seen too in both the old Baptist and the Congregational Churches, both of which he helped to build, and both of which he saw burned to ashes.  But he, too, like so many of our old residents within the past few years has passed to his rest.  And to all of us came a feeling of sadness, as for the loss of a friend, when we heard that Elijah Lewis was dead. In Pharsalia, N.Y. [Chenango Co.], Dec. 12th, 1868, of cancer in the stomach, Mr. Avery C. Keator, aged 37 years.  Thus, a good man has passed away.  He lived a Christian and died in the full assurance of the Christian's home in heaven.

Death by Drowning

We noticed at the time, the death by drowning, of Miss Mary P. Gilbert, granddaughter of the late Capt. James Packer, of this village [Norwich, Chenango Co., NY], which occurred at Caton, Steuben Co. [NY], on the night of January 9th.  We copy from a Corning paper, the following particulars of the sad event:

"She left the kitchen door of the house for an outhouse a few rods distant.  She had to cross a ditch two feet wide and two feet deep through which, in the rainy season, water flows.  There were three pieces of plank over it for a bridge, but no railing.  A few feet above was a little dam erected by a boy for a tiny waterwheel. The melting of the snow filled the channel to overflowing.  The water ran over the dam, on which a board had been place, and also around each end of it with a strong current.  As Miss Gilbert did not return soon, search was made for her, and she was found dead, lying on her side, her head on one plank, her feet on the other, and her body sunk down into the ditch or channel.  The water was pouring over her face.  The body was immediately taken out, and for an hour and a half, efforts were made for resuscitation by Dr. E.S. May, of Caton, but in vain.  At the coroner's inquest it was considered that she must have fallen in on returning to the house. The little footbridge was not in a direct line with the light at the kitchen door, as the pathway diverged somewhat. there was a bruise upon the forehead, probably caused by falling against a post. Whether she was thus stunned and unable to get up or was wedged in as she fell so that she could not arise, nor get her face above the strong current of water that was flowing over it, none can tell.  In either case it is a terrible thought that she perished within the sound of the voices of the family, unable to raise a cry for help to rescue one beloved as a daughter and sister, and whose mournful fate will never cease to afflict a large circle of kindred."

She was a worthy young lady, about twenty-five years of age, and had resided with her grandfather for a number of years previous to his death.

Sudden Death

Suddenly, in this town [Norwich, Chenango Co., NY], Feb. 1st, Mr. James P. Curnalia, aged 74 years.

On Monday, February 1st, about 4 P.M., while returning home from a visit to some friends in Preston, Mr. James P. Curnalia instantly expired on the road, about three miles east of this village.  He was about half a mile from his son's, when found.  Mr. David Field, who resides in the east part of this town, and was returning home from this place, was the first to find him.  Mr. Field thinks the deceased could not have been more than five minutes ahead of him.  When found, his body was warm.  He was soon taken to his son's but means of restoring him were useless, as he was quite dead.  

Death of William Weiler

Suddenly, in this village [Norwich, Chenango Co., NY], Feb. 5th, Mr. William Weiler, aged 42 years.

Our citizens were shocked on Friday morning last, by the announcement of the sudden death of William Weiler, which took place at an early hour that morning.  He had for some time previous been indisposed, and remained at his home, although there was nothing alarming in his symptoms.  During Thursday he was feeling much better than formerly and sat in his chair reading through the evening, retiring to his bed about 11 o'clock.  Between twelve and one o'clock his wife was awakened by his unnatural breathing.  Help was summoned at once and every effort made to arouse him, but to no avail.  He lived but a few minutes after his situation was discovered.  It is the opinion of his physician that his death was caused by the rupture of the main artery, near the heart.  He was a native of Germany.

Mr. Weiler's death deserves more than a passing notice at our hands.  He was one of our adopted fellow citizens, who knew well how to prize our institutions, and whose habits of industry and thrift made him at once the leader and counsellor of his fellows, who like him had fled from a land of oppression and tyranny.  He came to our village about fifteen years ago, and with but little, if any, means commenced the business of a cigar manufacturer, and by a course of honest, fair and polite attention to the wants of all, had built up a manufacturing business which at the time of his death was second to but one in our village.

His kindness of heart attached to him friends from all circles.  His prompt attention to business gave him the confidence of all.  His fidelity to the principles of true freedom, and his persistent advocacy of them, won for him the respect even of his opposers, while his love for his fellow men and his genial good nature bound him to all with whom he came in contact.

The respect and affection of the people for him was shown by the large attendance at his funeral on Sunday.  His remains were fittingly attended to their last resting place, by the members of the Cigar Makers' Union, the Norwich Fire Department, and the members of the Masonic order, from this and other towns, of which organizations he was an honored and trusted member.  He strove to do his duty in all positions of life, and upon his completed record we may endorse, "Well Done," in the assurance that we render the verdict of all who knew him.

The funeral sermon was preached by Rev. Mr. Barrow of Mansfield on Sunday afternoon last, in the Episcopal Church of this village, where an appropriate and impressive address was delivered.  James was a young man esteemed and beloved by all who knew him.  A large assemblage of deeply afflicted friends followed his remains to the cemetery and testified by their presence and sympathies on the occasion, the high esteem in which the deceased and the bereaved family were held.  Wellsboro, Pa., Democrat.

Fatal Accident on the Midland: Patrick McAndrews, a laborer on the railroad, was buried by an embankment caving in upon him, while excavating near Eaton [Madison Co., NY], on the 7th inst.  He was taken out alive but survived but a few hours.  He leaves a wife and child.  Two others were caught in the same gravel bank but escaped with some severe bruises.

Drowned:  By a dispatch received by friends in this place, on Monday last, we learn that Miss Mary P. Gilbert, granddaughter of the late Capt. James Packer, of this village [Norwich, Chenango Co., NY], and for a number of years previous to his death a member of his family, was drowned, at Caton, Steuben Co. [NY], on Sunday. We have no particulars.

In Greene [Chenango Co., NY], Jan. 9th, Warren Gray, Esq., aged 84 years.

We learn from a dispatch received by the Masonic Fraternity of Norwich, that Warren Gray, Esq. of Greene, died suddenly in the latter village on Saturday morning last, the 9th inst. at the venerable age of 84 years.

Mr. Gray was a well-known citizen of this County [Chenango Co., NY], and one of the most esteemed and respected of our people.  For nearly or quite fifty years, almost continuously, he was a Justice of the Peace of the town of Greene, holding the office at the time of his decease.  Through all the mutations and vicissitudes of the political party to which he belonged; his personal popularity was such that he was uniformly elected by his fellow citizens when presented for that position.

In Politics Mr. Gray was a Democrat of the old school. His venerable form was often seen in our County Conventions, where he always took a prominent and influential part.  He believed religiously and conscientiously in the principles of Jefferson and the early fathers of the Democratic party, adhering to them with scrupulous fidelity and devotion throughout his long and honorable life.  At one time he was the candidate of the Democrats of this County for the office of Sheriff, but in common with the rest of the Democratic ticket the same year, failed of success.

In all the relations of life, public and private, Warren Gray was a true, noble, conscientious man.  His memory will be long and carefully cherished by the community in which he lived, and by all who knew his virtues and his worth.

His remains were consigned to their last resting place, in the village cemetery at Greene, on monday of this week, by the masonic Order, of which he was a high and honored member, a large concourse of the Fraternity and of citizens having gathered from his own and all the adjoining towns, to pay his memory this mark of their respect.

Peck, aged 71 years and 10 months.  Mr. Peck came from Dutchess County, N.Y., at an early day, and settled on a farm in Pharsalia, Chenango County [NY], whence he spent about forty years in the cultivation of the soil.  His life was quiet, harmonious and unassuming, and few men have acquired such a high place in the esteem of their fellow beings as he.  His gentleness of disposition and integrity of character won a loving response from all with whom he was thrown in contact.  A tender father, faithful husband and friend.  He has left a wife and one daughter to forever cherish his love, be proud of his many virtues and to await the time for a reunion in the "Better Land."

In Franklinville, NY. [Cattaraugus Co., NY], Nov. 25th, Mrs. Genie C. Hall, wife of Seth E. Hall and daughter of Geo. C.  Mead, formerly of Smyrna [Chenango Co., NY], aged 23 years.  In this case death struck a shining mark, one beloved by a large circle of friends.  Although her sun went down at early noon, it was tranquil as departing day, amid the mellow radiance of a summer sunset.

In Norwich [Chenango Co., NY], Nov. 10th, Mr. Edson French, aged 31 years and 9 months.  The deceased was a young man who bore an irreproachable character, always peaceable and obliging in his dealings, upright and honest.  His willingness to assist others drew to him the warmest affection of all who knew him. But thus, by the mysterious visitation of Providence, we bow our sorrowful hearts in humble submission to the Great Dispenser of all events, knowing that "He doeth all things well."

Sad and Fatal Accident:  The Greene American [Chenango Co., NY], states that a fatal accident occurred Monday evening, the 14th inst., on the Indian Brook about three miles southwest of Greene, Leroy Adams, a little boy about nine years old, son of Ezra Adams, left home in the evening to spend an hour or two at Mrs. Wm. C. Dunn's. While there he and Willie Dunn, a boy about eleven years old, played with a rifle, unaware that it was loaded, when by some accident it was suddenly discharged and shot Leroy through the head; the ball entered the base of the skull in front, and came out on the back side of the head, producing death in five or ten minutes.
